Extended Producer Responsibility (EPR) has become one of the most critical environmental compliance frameworks in India. If you are a Producer, Importer, or Brand Owner (PIBO) introducing plastic packaging, electronic products, batteries, or tyres into the Indian consumer market, securing an EPR registration from the Central Pollution Control Board (CPCB) is legally mandatory.

What is Extended Producer Responsibility (EPR)?

EPR is a policy approach under which producers are given a significant financial and physical responsibility for the treatment or disposal of post-consumer products. Fulfilling EPR encourages eco-friendly product designs and structures waste collection systems to keep hazardous materials out of landfills.

Who Needs EPR Registration in India?

According to Plastic Waste Management (PWM) Rules and E-Waste Management Rules, the following entities must register on the CPCB portal:

  1. Producers: Manufacturers of plastic packaging or electronic goods.
  2. Importers: Companies importing plastic packaged items, raw plastic sheets, electronic devices, batteries, or tyres for commercial trade.
  3. Brand Owners: Retailers and e-commerce platforms selling products under their own registered trademarks or brand names using plastic wrapping.

Key Categories of Plastic Packaging Under EPR

Plastic packaging is classified into four main categories on the CPCB portal:

  • Category I (Rigid Plastics): Items like bottles, jars, crates, and heavy trays.
  • Category II (Flexible Plastics): Single or multilayer plastic sheets, carry bags, and bubble wraps.
  • Category III (Multilayered Packaging): Materials consisting of at least one layer of plastic combined with other materials like aluminum foil or paper board (e.g., juice packs).
  • Category IV (Compostable Plastics): Biodegradable carry bags and food packaging sheets.

Understanding EPR Targets

Your annual EPR target is calculated as a percentage of the average weight of plastic packaging or products you introduced to the market in the preceding two financial years.

For example, if an importer brought in 100 Metric Tons (MT) of Category II plastic packaging in FY 24-25, their recycling target for FY 25-26 will be calculated as a direct percentage (usually 100% for recent imports), meaning they must purchase corresponding EPR credits from registered recyclers.

The EPR Registration Process

Filing for an EPR certificate follows a structured path:

  1. Portal Registration: Set up an account on the central CPCB portal.
  2. Quantification Audit: Compile detailed reports of imports or manufacturing sales invoices for the past two fiscal years, separating plastic weights by categories.
  3. SPCB/CPCB review: State and Central Pollution Control Board officers examine the application and check for raw material calculations, bills of lading, and consent certifications (CTE/CTO).
  4. Target Generation: The portal computes your mandatory recycling obligation.
  5. Certificate Issuance: Once the application is approved, CPCB issues the digital EPR registration certificate containing a unique registration code.

Consequences of Non-Compliance

Failing to register or purchase sufficient EPR credits leads to heavy Environmental Compensation (EC) penalties. CPCB holds the power to impose daily compounding fines, issue show-cause notices, or even order closure of importing and manufacturing operations.
