Category-Wise Trademark Documents Checklist
1. For Individual / Proprietorship Applicants:
- PAN Card & Aadhaar Card: To verify the identity and address of the applicant.
- Logo/Brand Artwork: A clean JPEG/PNG file of the logo. If you wish to protect only the brand name, specify it as a "Wordmark".
- Signed Authorization (Form TM-48): Power of Attorney authorizing the trademark attorney or agent to file on your behalf.
- User Affidavit (If applicable): If the mark is already in use in India prior to the date of filing, an affidavit with proof of use (invoices, websites, media ads) must be submitted.
2. For Companies, LLPs, and Partnerships:
- Entity PAN Card: Corporate PAN details.
- Incorporation proof: Certificate of Incorporation (COI) or registered Partnership Deed.
- Signed TM-48 Power of Attorney: Printed on stamp paper and signed by the authorized director or partner.
- MSME / Udyam Certificate: Highly recommended! Government offers a 50% discount on statutory trademark filing fees for registered MSMEs.
- User Affidavit: Signed by the authorized representative, detailing prior brand usage proofs.
Understanding Class Categorization
Before filing, your brand must be categorized under one or more of the 45 Trademark Classes under the Nice Classification system:
- Classes 1 to 34 cover manufacturing of physical goods (e.g., Class 25 for apparel, Class 3 for cosmetics).
- Classes 35 to 45 cover service operations (e.g., Class 35 for retail/marketing, Class 42 for IT/software services).
Selecting the wrong class can leave your business unprotected or lead to quick rejections.
The Trademark Registration Lifecycle
- Trademark Search: Check the public registry for conflicting marks.
- Application Filing: Submit Form TM-A with IP India and pay the statutory fee.
- Application Review: Trademark examiners check for distinctiveness or conflicts (relative/absolute grounds).
- Objections Reply: If examiners raise objections (e.g., Section 9 or Section 11), a legal reply must be filed within 30 days.
- Advertisement: The mark is published in the TM Journal for 4 months to allow public oppositions.
- Registration: If no opposition is received, the trademark registration certificate is issued.
